MEDPRO EXTREME RENTAL AGREEMENT
This Equipment Rental Agreement (“Agreement”) is entered into between MedPro Extreme Company Limited, hereinafter referred to as the “Company”, and the undersigned individual or organization, hereinafter referred to as the “Renter”.
By signing this Agreement or submitting a rental booking, the Renter acknowledges that they have read, understood, and agree to all terms and conditions herein. This Agreement is binding under the jurisdiction of the Kingdom of Thailand.
1. NOTICE & AGREEMENT OVERVIEW
1.1 This Agreement governs the rental of equipment owned by the Company to the Renter.
1.2 By accepting possession of the equipment, the Renter affirms their acceptance of all terms.
1.3 Non-compliance with these terms may result in:
Forfeiture of deposit,
Additional charges,
Legal action, including civil claims or criminal prosecution, and
Permanent prohibition from future rentals.
2. RESERVATION & BOOKING TERMS
2.1 Eligibility: The Renter must be at least eighteen (18) years of age and legally competent to enter into binding contracts.
2.2 Identification: A valid government-issued photo ID (passport, national ID, or driver’s license) must be presented prior to equipment release.
2.3 Payment & Confirmation
Full rental fee and the required security deposit must be paid before the release of the equipment.
The Agreement must be signed prior to the rental period commencing.
No equipment shall be released without completed payment and signature.
2.4 Company’s Right to Refuse: The Company reserves the sole discretion to refuse any rental if eligibility or safety requirements are not met.
2.5 Misrepresentation: Any false, misleading, or incomplete information provided by the Renter shall result in automatic cancellation of the booking without refund. If booking on behalf of an organization, the signatory must have lawful authority to bind said entity.
3. SECURITY DEPOSIT POLICy
3.1 A security deposit is required for all rentals. The deposit is distinct from the rental fee.
3.2 The deposit amount will be disclosed at the time of booking and is based on the value of the equipment.
3.3 Deposits shall be refunded within seven (7) business days after the equipment is returned and inspected.
3.4 Deposit Deductions: The Company may partially or fully deduct the deposit under the following circumstances:
Equipment is returned damaged, incomplete, altered, or modified.
Equipment is returned late.
Equipment is returned excessively dirty, requiring professional cleaning (cleaning fee: THB 500–2,000).
3.5 Excess Damages: If damages exceed the deposit, the Renter is liable for the balance and must pay within seven (7) business days of invoice.
4. RENTAL PERIOD, EXTENSIONS & RETURNS
4.1 The rental period shall commence and terminate on the dates and times specified in the Agreement.
4.2 The Renter is obligated to return equipment on or before the agreed return date/time.
4.3 Extensions must be requested in advance and are subject to availability and additional fees.
4.4 Unauthorized late returns shall incur penalties under the Late Return Policy.
4.5 If equipment is not returned within 48 hours of the scheduled time without prior approval, the Company may deem it stolen, file a police report, and pursue both civil and criminal remedies.
5. LATE RETURN POLICy
5.1 A grace period of two (2) hours may be granted at the Company’s discretion.
5.2 Late returns beyond the grace period are charged as an additional full rental day at the prevailing daily rate.
5.3 Returns delayed by more than 24 hours may incur additional penalties.
5.4 Returns delayed by more than 48 hours shall be deemed unreturned, and the Company reserves the right to initiate legal proceedings, including theft charges.
5.5 The Renter shall be liable for consequential losses (e.g., cancellations of subsequent bookings caused by the delay).
6. CANCELLATION & REFUND POLICY
6.1 Full Refund: Cancellations made at least seven (7) days before the rental start date.
6.2 Partial Refund: Cancellations made between three (3) and six (6) days before the start date incur a 50% cancellation fee.
6.3 No Refund: Cancellations within three (3) days of the start date or no-shows on the pickup date.
6.4 Deposits: Non-refundable for last-minute cancellations (less than three (3) days).
7. USAGE RESTRICTIONS & PROHIBITED ACTIVITIES
7.1 The Renter shall use the equipment only for its intended purpose and in accordance with all safety guidelines.
7.2 The following are strictly prohibited:
Subleasing or transferring possession to third parties.
Using equipment for unlawful or unsafe activities.
Transporting equipment outside the agreed geographic area or across borders without prior written approval.
Operating equipment under the influence of alcohol, drugs, or impairing substances.
Using equipment in professional rescue operations unless expressly authorized in writing by the Company.
7.3 Breach of these conditions may result in immediate termination of the rental, forfeiture of the deposit, liability for damages, and legal action.
8. DAMAGE, LOSS & REPLACEMENT LIABILITY
8.1 The Renter bears full responsibility for any loss, theft, or damage from the moment of possession until return.
8.2 Normal Wear & Tear: Minor scratches, superficial abrasions, and rope fuzz are considered normal and not chargeable.
8.3 Negligence or Misuse: Cuts, burns, exposure to chemicals, improper storage, or unauthorized modifications will be charged at repair or replacement cost.
8.4 If equipment is lost or stolen, the Renter must:
Notify the Company immediately, and
File a police report within 24 hours.
8.5 Replacement Value: The Renter agrees to pay the full current retail replacement value of the item(s) within seven (7) business days of invoice.
9. LIABILITY WAIVER & INSURANCE REQUIREMENTS
9.1 The Renter assumes all risks associated with the use of rented equipment.
9.2 The Company disclaims all liability for injury, death, property damage, or consequential loss arising from equipment use.
9.3 Where equipment requires specialized training or certification, the Renter must present proof of qualification prior to release.
9.4 For high-value equipment (e.g., boats, rope systems, mannequins, medical kits), the Company reserves the right to require:
Proof of adequate insurance coverage, or
A signed acceptance of full replacement liability.
10. EQUIPMENT INSPECTION & CONDITION REPORT
10.1 Prior to release, the Company and Renter shall complete and sign an Equipment Condition Checklist noting the state of the equipment, serial numbers, and accessories.
10.2 Upon return, the same checklist shall be used to verify condition.
10.3 Any unrecorded damage or missing items shall be presumed to have occurred during the rental period and charged accordingly.
11. FORCE MAJEURE POLICY
11.1 The Company shall not be held liable for delays, cancellations, or failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, extreme weather, pandemics, civil unrest, or government-imposed restrictions.
11.2 In such cases, refunds, credits, or rescheduling shall be offered at the Company’s discretion
12. LEGAL ACTION & DISPUTE RESOLUTIOn
12.1 This Agreement is governed by the laws of the Kingdom of Thailand.
12.2 Parties agree to first attempt resolution through negotiation.
12.3 If unresolved, disputes may be referred to arbitration in Bangkok, Thailand, or adjudicated in Thai courts at the Company’s discretion.
12.4 The prevailing party in any legal action shall be entitled to recover reasonable legal fees and costs.
13. AGREEMENT ACKNOWLEDGMENT & SIGNATURE
By signing MedPro Extreme’s rental policy agreement, the Renter confirms and agrees that they:
☑ Have read and understood all terms of this Agreement.
☑ Accept full responsibility for the rented equipment during the rental period.
☑ Acknowledge that breach of these terms may result in deposit forfeiture, additional charges, or legal action.
